Terms of Service

These terms are the agreement between you and Empathy Enterprises LLC, 30 N Gould Street, Suite R, Sheridan, WY 82801, USA, for the use of
FamilyArchiveAI at family-archive-ai.com. "We" and "us" mean Empathy
Enterprises LLC. "You" means you.
By buying or using FamilyArchiveAI, you agree to these terms. If you do not agree, do not use it.
1. What FamilyArchiveAI is
You photograph your printed photos and upload them. Our software separates individual prints, straightens and rotates them, estimates dates and locations, reads text including handwriting on the back, groups photographs by the faces in them, and makes the result searchable. The finished archive is written to your own Google Drive.
Optional repair and colorization of individual photographs is available for an additional fee and is not included in the base price.
2. Who can use it
You must be at least 18 years old and able to enter a binding contract. If you are using this on behalf of a company or an estate, you are telling us you have the authority to accept these terms for them.
3. What you pay
The price, what is included, and any add-on pricing are as shown on the checkout page at the time you buy. Prices are in US dollars. You are responsible for any taxes that apply where you live.
The base price covers up to 1,000 photographs. Additional photographs are billed as described at checkout.
4. Refunds
You have 30 days from purchase to request a full refund, for any reason.

After a refund, we delete your uploaded files from our servers, and your access ends. Files already written to your own Google Drive remain in your
Drive, and remain yours.
5. Your photos stay yours
You keep all ownership and all rights in the photographs and files you upload. We claim nothing.
To actually do the job, you give us a limited license to store, copy, display, and process your files, and to create derived information from them such as dates, locations, extracted text, and, if you turn it on, face groupings. This license exists only so we can build your archive and support you. It is not transferable except to the providers listed in our
Privacy Policy, it is not exclusive, and it ends when you delete your files or receive a refund.
We will not use your photographs to train or improve artificial intelligence models, to advertise, or for any purpose other than providing the service to you.
6. What you promise us
When you upload photographs, you are telling us that:
- You own them or otherwise have the right to upload and process them
- Uploading them does not violate anyone else's rights
- You have any consent required from the people shown in them, to the extent the law requires it of you
- The content is not illegal
You are responsible for the photographs you upload. If someone shown in them objects, we may contact you and we may remove the material.
7. Things you may not do
Do not use FamilyArchiveAI to:
- Upload content you have no right to upload
- Identify or surveil people without their knowledge
- Upload sexual content involving minors, or any illegal content
- Attempt to break, overload, reverse engineer, or gain unauthorized access to the service
- Resell the service, or run it as a bulk digitization business for third parties, without our written agreement
- Break any law
We can suspend or end your access if you do any of these.
8. What the software gets wrong
Read this part carefully, because it is about expectations.
Our software makes automated estimates. It will sometimes date a photograph to the wrong year. It will sometimes group two different people together, or split one person into two groups. It will sometimes misread handwriting.
Repair and colorization produce an interpretation of what a damaged or black and white photograph might have looked like, not a factual record of what it did look like.
All of these outputs are provided for your convenience. Do not rely on them as fact for genealogy, legal, medical, or historical purposes without checking them yourself.
9. We are not a backup service
FamilyArchiveAI is not a backup, an archive of record, or a storage service. Keep your original prints. Keep your own copies of the digital files. Your finished archive lives in your Google Drive, and your Google
Drive is governed by your agreement with Google, not with us.
10. Availability
We try to keep the service running, but we do not promise it will be available at all times or free of errors. We may change, suspend, or stop offering features. If we discontinue the service entirely, we will give you reasonable notice and time to retrieve your files.
11. Ending it
You can stop using the service at any time and ask us to delete your data.
We can suspend or end your access if you break these terms, if we are required to by law, or if we stop offering the service. Sections 5, 8, 9, 12, 13, 14, and 15 survive the end of this agreement.
12. No warranties
The service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty about accuracy, reliability, or uninterrupted availability.
Some jurisdictions do not allow the exclusion of certain warranties, so some of this may not apply to you.
13. Limit on what we owe you
To the fullest extent permitted by law:
We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, even if we were told such damages were possible.
Our total liability to you for any claim relating to FamilyArchiveAI is limited to the amount you actually paid us in the 12 months before the claim arose.
Some jurisdictions do not allow these limits, so some of this may not apply to you. If you are a consumer in the EEA or the UK, nothing here limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.
14. If you cause us a problem
You agree to defend and indemnify us against claims, damages, and reasonable legal costs arising from your use of the service, your breach of these terms, or content you uploaded that you did not have the right to upload.
15. Disagreements
Governing law.
These terms are governed by the laws of the State of
Wyoming, USA, without regard to conflict of law rules.
First, talk to us.
Before filing anything, email dan@dsgeyer.com with a description of the problem and what you want. We will try to resolve it within 60 days.
Courts.
If we cannot resolve it, either of us may bring a claim in the state or federal courts located in Wyoming. We do not require arbitration.
If you are a consumer in the EEA or the UK, nothing here removes your right to bring a claim in your local courts or under your local consumer law.
16. The rest
- These terms, plus the Privacy Policy, are the whole agreement between us.
- If a court finds part of these terms unenforceable, the rest still holds.
- If we do not enforce something right away, we have not given up the right to enforce it later.
- You may not transfer your rights under these terms. We may transfer ours in a merger or sale of the business.
- We may update these terms. For material changes we will update the date above and email the address on your order before the change takes effect.
Continuing to use the service after that means you accept the new terms.
